Terms and Conditions

By engaging with Pilot Butte Promos (“we,” “our,” “us”), you agree to the following terms and conditions for liquor activation services. These terms apply to all interactions, transactions, and activities related to the purchase, sale, or promotion of alcoholic beverages as part of our services.

1.1 Definitions

• Liquor Activation refers to events, promotions, tastings, or any activity involving the sale, sampling, or promotion of alcoholic beverages.
  
• Client refers to the individual or organization requesting or hiring our services.
  
• Participant refers to any person attending or engaging in the event or promotion.
  
  

1.2 Acceptance of Terms
By engaging with us for liquor activation services, you confirm that you have read, understood, and agreed to these Terms and Conditions.

2.1 Age Requirement
All participants in liquor activation events must be at least 21 years of age, or the legal drinking age applicable in the jurisdiction where the event takes place.

2.2 Compliance with Laws
We comply with all relevant laws and regulations concerning the promotion, sale, and distribution of alcohol. Clients and participants must also adhere to local, state, and national regulations regarding alcohol consumption and distribution.

2.3 Responsible Drinking
We promote responsible drinking at all events. The Client and Participants agree not to engage in excessive drinking, disruptive behavior, or underage drinking.

3.1 Booking Confirmation
Bookings are only considered confirmed upon the execution of a formal agreement and receipt of a deposit or full payment, depending on the terms of the agreement.

3.2 Payment Terms
The Client agrees to pay for all services rendered in accordance with the payment schedule outlined in the agreement. All payments are non-refundable unless stated otherwise.

3.3 Cancellation Policy
If the Client cancels the event or promotion more than 3 days prior to the scheduled date, a 40% cancellation fee will apply. Cancellations made within 7 days of the event will incur a 20% charge of the total event cost.

4.1 Scope of Services
Our services include, but are not limited to, organizing liquor tastings, promotional activations, event planning, staff provision (bartenders, servers), and the supply of alcoholic beverages, as agreed upon in the contract.

4.2 Alcohol Supply
Clients will need to supply the alcohol. All alcohol supplied must comply with local regulations and be purchased from licensed distributors.

4.3 Staffing and Supervision
We provide trained and licensed staff for the activation. We retain the right to remove any participant or staff member who fails to comply with these terms or engages in unsafe, disruptive, or illegal behavior.

5.1 Prohibited Behavior
Participants are prohibited from:

• Consuming alcohol if they are underage.
  
• Engaging in violent, illegal, or disruptive behavior.
  
• Carrying or distributing alcohol outside the designated event area.
  
• Smoking in prohibited areas or engaging in any illegal activities during the event.
  
  

5.2 Right to Refuse Service
We reserve the right to refuse service or remove any participant who appears intoxicated, behaves inappropriately, or fails to comply with these terms.

6.1 Limitation of Liability
We are not liable for any direct, indirect, incidental, or consequential damages that may arise from your participation in any liquor activation event, including but not limited to injury, illness, or property damage.

6.2 Indemnity
The Client agrees to indemnify and hold Pilot Butte Promos harmless from any claims, losses, damages, or legal costs arising from any breach of these terms or from the Client’s actions or omissions during the event.

6.3 Force Majeure
We are not responsible for any delay or failure to perform obligations caused by circumstances beyond our control, including but not limited to natural disasters, acts of war, strikes, or government action.

7.1 COVID-19 and Other Health Protocols
The Client agrees to comply with any public health measures or restrictions in place, including COVID-19 protocols, and will cooperate with us in ensuring the health and safety of all event participants.

7.2 Emergency Procedures
We will establish emergency procedures for each event to ensure participant safety. The Client must ensure all participants are informed of the procedures and cooperate fully in case of an emergency.

8.1 Personal Data
We collect personal information as part of our event booking process. This information will be used solely for event-related purposes, in compliance with applicable privacy laws.

8.2 Data Sharing
We will not share personal data with third parties, except as required by law or to facilitate the event (such as sharing participant data with venue providers).

9.1 Use of Branding
Any promotional materials, trademarks, or intellectual property provided by the Client or us shall remain the property of the respective party. Clients may not use our brand name, logos, or any other intellectual property without express written permission.

We may revise and update these terms at any time. Any changes will be communicated to the Client, and continued engagement with our services after such changes constitutes acceptance of the revised terms.

These terms are governed by and construed in accordance with the laws of State of Oregon Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts located in the state of Oregon.
